These terms and conditions are entered into by and between KBM Strategies (parent company of District Fitness and Gear Up (hereinafter: Gear Up - District) and You (hereinafter: the Member).
Services: The District membership entitles the usage of the District Fitness Facility, the Gear Up web portal and mobile app with access to live fitness classes, workouts and select webinars and live heart rate tracking. The Gear Up membership entitles the usage of the Gear Up web portal and mobile app with access to live fitness classes, workouts and select webinars.
Payment: The Member commits to paying the membership fee on a recurring, monthly basis until the Member cancels. Membership fee will be automatically deducted each month on the 1st.
Cancellation: The Member has the right to cancel their membership at any time by sending a request to info@district.fitness.ca or info@gearup.fitness. Member will be charged one more monthly membership fee if Member does not cancel prior to their monthly payment date.
Communication: Gear Up - District communicates via email. Gear Up - District declines all responsibility if the email address doesn't exist, is wrong or for whatever reason emails do not arrive to the Member.
Health: The Member confirms that he/she does not suffer from health problems that would hinder exercise or prevent him/her from engaging in exercise, or that would be detrimental or adverse to the Members health, safety, or physical condition if he/she did exercise. In case of any doubt, the Member shall seek advice by a medical doctor who should confirm the ability to exercise. Gear Up - District shall have no obligation to perform a fitness assessment or similar testing to determine the Members physical condition.
Insurance: The Member confirms that he/she holds the necessary insurances to cover any accident or training incident.
Waiver of Liability: Any and all use of the Gear Up – District services offered onsite at District or while at home, in another fitness facility, office or outdoors shall be at Members own risk at all times. Gear Up – District shall not be liable for any injuries, physical impact or damages to the Member, or the property of the Member.
